E-Sign & Electronic Communications Notice

Introduction

This E-Sign & Electronic Communications Notice ("Notice") applies to all communications related to your BIX Card Account and any related products or services provided by Third National ("Issuer," "we," "us," or "our") in connection with BIX (operated by Bix, "BIX" or "bixbix").

By applying for, activating, or using a BIX Card, you consent to receive all communications from us electronically. This Notice is incorporated by reference into your BIX Card Cardholder Agreement and/or BIX Spend Card Terms (collectively, "Card Terms").

Your Consent to Electronic Communications

You agree and consent to receive electronically all communications, agreements, documents, notices, and disclosures (collectively, "Communications") that we provide in connection with your Account, your Card, and your use of our services, including but not limited to:

Your Card Terms and any amendments thereto

Privacy notices and policies

Account statements and transaction histories

Notices or disclosures regarding your Account (including changes in terms, fees, or interest rates)

Tax statements and documents

Regulatory communications required by federal or state law

Any other communications related to your Account or the Services

Method of Delivery

We may provide Communications to you by:

Posting them on the BIX website or mobile application

Sending them to the email address associated with your Account

Sending them via push notification through the BIX mobile application

Making them available through your Account dashboard

Any other electronic means we deem appropriate

Hardware and Software Requirements

To receive and retain electronic Communications, you will need:

A computer or mobile device with internet access

A current web browser that supports 128-bit encryption (e.g., the current version of Chrome, Firefox, Safari, or Edge)

An email account and email software capable of receiving email

Sufficient storage space or an installed printer to save or print Communications

You are responsible for maintaining hardware and software that meets these requirements. If our requirements change and create a material risk that you will not be able to receive Communications electronically, we will notify you and provide you with information on how to update your hardware or software.

Requesting Paper Copies

You have the right to receive paper copies of any Communication. To request a paper copy, contact us at:

We may charge a fee of up to $10.00 for each paper copy, as disclosed in your Card Terms. Paper copies will be sent to the mailing address on file for your Account.

Updating Your Contact Information

You must keep your email address and other contact information current. To update your information, log into your BIX Account or contact us at support@bix.

If we send a Communication to the email address on file and it is returned as undeliverable, we may consider your consent to electronic communications to be withdrawn, and we may suspend or close your Account.

Withdrawing Consent

You may withdraw your consent to receive electronic Communications at any time by contacting us at support@bixpay.io or calling +1 (787) 500-0199. If you withdraw your consent:

We may restrict, suspend, or close your Account, as your consent to electronic communications is a condition of having an Account.

Your withdrawal will not affect the legal validity or enforceability of any Communications previously provided to you electronically.

We will confirm your withdrawal in writing (which may be delivered electronically before the withdrawal takes effect).

Federal and State Law

Your consent to receive electronic Communications and the legal validity of such Communications is governed by the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq., and applicable state laws. You acknowledge that electronic Communications satisfy any legal requirement that such Communications be in writing.
